Terms of Service
1. About these terms
The Abel app and the services you get access to through it (the “Service”) are provided by Abel Technologies AS, company registration number 919 608 811 (“Abel”, “we”). By creating an account and starting to use the Service, you accept these terms. Whoever uses the Service is referred to as the “User” or “you”.
By downloading the app from the App Store or Google Play, you also accept their terms.
Information about how we process personal data can be found in our Privacy Policy, which is available in the app.
2. What the Service is
The Service is a digital health and lifestyle service with two levels:
- Basic features: recording and following up training, meals, habits, goals and your own measurements, connecting a training watch or other wearable technology, gathering your health data in one place and taking part in training communities. You use the basic features on your own, without a health counsellor.
- The counselling service: personal follow-up from a health counsellor, with chat, training and meal plans, surveys and regular check-ins. You get the counselling service through your employer, or by purchasing it yourself in the app.
Health counselling is advice and support about training, diet and lifestyle. It is not medical treatment or healthcare, and the health counsellor does not replace a doctor. In the event of illness or symptoms, you should contact a doctor.
The Service is not intended for emergencies: in an acute and serious situation, call 113 in Norway and 112 in Europe.
3. Requirements for using the Service
- You must identify yourself with BankID or another strong electronic ID in order to create an account.
- You must be 16 or older to create an account that does not involve a payment obligation. You must be 18 or older to purchase a subscription or another service yourself, unless the purchase is made with funds you are legally entitled to dispose of, or a guardian has approved the purchase.
- You are responsible for ensuring that the information you provide is accurate and up to date.
- The account is personal. You are yourself responsible for keeping your login secret, and for ensuring that nobody else uses your account.
- You must have internet access and a suitable device. With a weak connection, the quality of the Service may be reduced.
4. Use through your employer
Many people get access to the counselling service through their employer. The following then applies in addition:
- Which services you have access to follows from the agreement between Abel and your employer.
- The account and its content are personal. Your employer does not get access to your messages, your surveys, your measurements or other health and activity data at an individual level. If you expressly request or approve that specific data be shared as part of work-related follow-up, the data concerned may be shared within the limits of what you have approved. Otherwise your employer may only receive anonymised or sufficiently aggregated statistics that cannot be linked to you as an individual. Further information is set out in the privacy policy.
- When your employment or the agreement between Abel and your employer ends, the access that was covered by the employer ends. You keep your account and the basic features, and may choose to continue services at your own expense.
5. Your health counsellor
A counselling relationship begins when you accept a health counsellor in the app. The health counsellor is given access to the data that is necessary in order to follow you up. Before you accept, you are told which data the counsellor is given access to. This is also described in the privacy policy.
You can end the counselling relationship in the app at any time. The counsellor's ordinary access then ends. Data is erased or stored further in accordance with the privacy policy and the applicable retention periods. If your counsellor becomes unavailable, Abel may offer you another health counsellor.
6. Prices and payment
It is free to download the app and create an account with the basic features that are offered free of charge at any given time. The price, subscription period, payment interval and content of services you purchase yourself are shown clearly before the purchase is confirmed.
Price changes are notified on a durable medium at least 30 days before they take effect. A price change does not take effect for a period already paid for. If you do not accept a price increase, you can cancel the subscription before the change takes effect.
7. Right of withdrawal
When you purchase a service as a consumer, you have as a general rule a 14-day right of withdrawal from the time the agreement is entered into. You receive information about the right of withdrawal and a withdrawal form before the purchase.
If you expressly request that a service start before the withdrawal period has expired, and you then exercise the right of withdrawal, Abel may charge for the part of the service that has been delivered up until we receive notice that you are exercising the right of withdrawal. The right of withdrawal falls away only when the service has been completed, provided delivery began with your express prior consent and you have acknowledged that the right of withdrawal is lost when the service is completed.
For digital content that is not supplied on a physical medium, the right of withdrawal may fall away when delivery begins, provided you have expressly consented in advance to it starting, acknowledged that the right of withdrawal is thereby lost, and received confirmation of the agreement.
You can exercise the right of withdrawal by sending a clear message via the contact form, or by using the withdrawal form at abel.no.
8. Use that is not permitted
In the event of a breach of the terms, Abel may — depending on the nature and seriousness of the breach — limit or temporarily block access to all or part of the Service. As a general rule you are to be notified and given a reasonable opportunity to remedy the situation before the account is closed. This does not apply where the breach is serious, repeated, unlawful, or entails a risk to other users, health counsellors, Abel or the security of the Service. You are given information about the reasoning, and about how to contact us if you believe the decision is wrong.
Any liability in damages is determined according to the general rules of the law of damages.
9. Intellectual property rights
Abel owns all rights to the Service and its content, including software, design, text, plans and trademarks. You are granted a personal, non-transferable right of use for as long as you have an account. Content from the Service may not be used beyond this without permission.
10. Liability and availability
Abel is to deliver the Service in accordance with the agreement and with the requirements that follow from mandatory consumer legislation, including the Norwegian Digital Services Act. If a defect or non-conformity arises, you may be entitled to rectification, a price reduction, cancellation and damages under the rules of that legislation. You must contact us within a reasonable time after you discovered, or ought to have discovered, the matter.
Abel is not liable for reduced functionality caused solely by the user's equipment, internet access or third-party solutions outside Abel's control, unless Abel is responsible for the integration or the compatibility under the agreement or the law. Nothing in the terms limits rights or claims you have under mandatory law.
The health counsellor bases the counselling on the information you provide and on the agreed scope of the Service. You are responsible for providing accurate and relevant information, and for contacting a doctor or other healthcare personnel when needed.
11. Changes
Abel may update and change the Service where this is necessary for reasons of security, legal or regulatory requirements, technical operation, compatibility, fault correction or further development. Changes are carried out at no extra cost to the user.
If a change adversely affects access to or use of the Service beyond what is entirely insignificant, you are notified on a durable medium a reasonable time before the change takes effect. The notice is to describe the change, the timing, and the right to terminate the agreement free of charge where the conditions for this are met.
We may also change the terms of use where there is objective justification. Material changes are notified before they take effect and do not have retroactive effect. Changes cannot limit rights you have under mandatory law.
12. Termination and deletion of the account
You can end a counselling relationship, cancel a subscription or ask to have your account deleted at any time. These are different actions, and the consequences are shown before you confirm your choice.
Before the account is deleted, you are told which content you will lose access to, and whether you have the option of exporting your own data. Personal data is erased or anonymised in accordance with the privacy policy and our set retention periods. Data may only be stored further where there is a documented legal basis for processing, or a legal obligation.
13. Complaints, choice of law and venue
If you wish to complain about the Service, we ask you to contact us first via the contact form at abel.no, so that we get the opportunity to handle the complaint.
If we do not reach agreement, a consumer can refer the matter to the Norwegian Consumer Authority (Forbrukertilsynet) for mediation. In cases covered by that scheme, the matter can then be required to be considered by the Norwegian Consumer Disputes Commission (Forbrukerklageutvalget). Further information is available on the Norwegian Consumer Authority's website. If another approved complaints body is the correct one for the service in question, the matter may instead be handled there.
The agreement is governed by Norwegian law. If you are resident in another country, you retain the mandatory consumer rights you have under the legislation of your country of residence. Disputes are handled by the ordinary courts, with the venue that follows from applicable law.
